Terms & Conditions
Effective Date: 1 July 2024
These Terms and Conditions (“Terms”) govern the contractual relationship between Preserve (“we,” “us,” or “our”) and the client (“you” or “your”) regarding painting services provided by Preserve. These Terms are applicable to all projects and services offered by Preserve and can be found on the Preserve website (www.preservepainting.com.au).
Contract
A contract must be in place before the commencement of any project, in accordance with the laws of Queensland (for jobs over $3,300).
Variation of Extras
You can request additional work at any time. Please inform the site foreman, who will provide a quote. All variations or extras must receive approval from both the Preserve Project Manager and the client prior to commencement.
Estimates and Pricing
All estimates provided by Preserve are based on current market conditions and are subject to change. Final pricing will be confirmed in writing before any work begins. The Client agrees to pay the specified amount outlined in the service agreement.
Payment Terms
A deposit of 30% is required upon acceptance of the estimate.
All invoices are due within 3 days from the invoice date.
Progress payments may be submitted weekly or fortnightly, depending on the project.
If invoices are not paid by the due date, work will be stopped.
Late payment will be subject to an initial 5% penalty, interest charges of 10% per month, and an administration fee of $50.
Any delays to the completion of works outside of Preserve's control or caused by others do not allow delays to payment times.
Important Note
All discussions, expectations, or assumptions regarding the painting works will be based solely on the content of this quote, any variations, or the contract. In the event of any work that may violate warranty terms, workplace health and safety regulations, product performance standards, or the ability to complete the work, Preserve’s final decision will take precedence.
Working Hours
This quotation is based on all work being carried out during normal working hours unless otherwise noted. If the work needs to be completed outside normal working hours, additional charges will apply. Normal working hours are Monday to Friday, 7 am – 3:30 pm, and Saturdays (optional).
Workplace Health & Safety
We will identify any hazards on the job and notify you if required. When working within 3 meters of a ‘Mains Power Connection’ that comes in from the street to your property, it must be isolated by a licensed electrician. If necessary, we can arrange this at a cost of $275 (including GST).
Pre-existing Hazardous Coatings
Unless otherwise noted, pre-existing toxic coatings, materials, or substances such as lead and/or chromate-based paints and/or asbestos-based substances will be subject to an additional cost for preparation and/or removal. Regarding rust, paint/epoxy/polyurethane systems are strong, but manufacturers do not warrant against rust reappearing as it is a substrate issue, not a coating issue.
Weather
If the weather is too wet, cold, or hot, we may cancel painting for the day for the purpose of paint warranties and the health and safety of our team.
Access
To ensure proper completion of the painting job, our team will need access to all areas to be painted, including internal areas to reach balconies or roof manholes. We will also need access to water, power, and a designated area for equipment and materials.
Application
The application will be carried out by brush, rollers, or spray at the sole discretion of the contractor. No allowance has been made to encapsulate the area.
Colours
Colours will be supplied at least 1 week before the start of the project unless matching existing colours.
Coats and Colour Selections
Preserve quotes include 2 coats only unless specified otherwise on the estimate. If the client-selected colours have poor coverage, additional coats may be requested or required. There will be additional costs for labour and paint for each additional coat required.
Warranties
Warranties of materials and workmanship will be provided when specifications are supplied and agreed upon.
Clean Up
We will make our best efforts to pick up as much debris as possible upon completion. However, we cannot guarantee the removal of all debris.
Important General Information – Preparation
Our onsite foremen are experienced tradespeople in the painting industry. They will make decisions based on their professional judgment. Generally, loose and flaking paint will be sanded or scraped to a sound surface. Bare areas will be spot primed, and minor holes or cracks will be filled. This quote excludes gapping under weatherboards and between VJ boards unless specifically stated, as it voids the manufacturer’s paint warranty.
Changes in Government Charges
During the term of the agreement/project, any new laws or regulations introduced by any level of government resulting in new or additional charges will be reflected in our invoices, either for increases or decreases in cost associated with these changes.
Your Responsibilities
You are responsible for the following:
Moving personal items or items of significant value.
Seeking clarification if you are unsure about any part of the painting process.
Providing written notification of any specific areas, items, or concerns prior to commencement that are not clearly expressed in writing on our quote.
Arranging for the removal and replacement of fixed ‘security’ screens or grills.
Trimming or removing trees and plants to allow clear access for painters to work.
Dismantling attachments such as cages, netting, or shade sails.
Recognising that Preserve Painting Services will exercise care and attention when moving items but will not be responsible for any damages incurred. Preserve reserves the right not to move or dismantle items that may be at risk of damage.
Liability
Preserve Painting Services carries liability insurance; however, it shall not be liable for any indirect or consequential damages arising from its services. The Client agrees to indemnify and hold harmless Preserve Painting Services from any claims resulting from their property.
Retention and Liquidated Damages
Preserve does not accept any monies held for retention or liquidated damages.
Do & Charge or Hourly Rate Works
Unless otherwise agreed, hourly rate works will be quoted depending on whether they are performed during normal or after hours. Hourly rate work will exclude materials or height access equipment.

Conditions that may cause additional costs:
Filthy surfaces - Damage to the walls & ceilings such as nicotine stains, grease, smoke damage, etc
Deep holes & dents - Excessive damage to plasterboard walls & ceiling will increase the price due to large amounts of patchwork required
Items to be removed - It is important to remember that professional painters are not removalists and that moving furniture and taking down blinds is not part of the allowed price to paint a house
Un-primed walls, trims, and doors ( requires full primer coat ) - Areas that have either been completely scraped back to bare or surfaces that are new plasterboard require priming before painting
Colours - Not all colours are created equal and darker colours are made from different bases. Any base colour other than white is more expensive. The concept of colour coverage is extremely important to understand as if a colour does not provide sufficient coverage in the quoted number of coats, additional coats will generally be a variation
Use of oil paint instead of acrylic - Oil-based paints generally take longer to dry and can make smaller jobs take longer due to extended drying times
Caulking of VJ boards - Filling all the cracks in the heritage walls & ceilings is extremely time-consuming. This process also uses large amounts of gap filler which can also be expensive depending on the brand of filler used. It is important to note that if you choose to go down this route using the “cheaper” gap filler brand will only crack at a later stage
VJ Boards, block or brick, pressed tin - Walls & ceilings that are not flat and require more attention to ensure paint coverage will ultimately increase labour time when working on the surface. This is due to paint spread rates, for example, when painting brick or block walls it takes 3 times the amount of time to paint compared to their plasterboard cousin.
Painting of just one room - Painting only one room will always incur more cost compared to painting two or three rooms at a time. This is due to the setup time & drying time. When painting one room at a time painters struggle to stay busy due to waiting for items to dry.
Conditions that can decrease your painting costs:
Multiple rooms - When a painter does not have to wait for drying time it allows an efficient work flow from process to process, which saves you labour time.
Furniture & small items removed from the work area - When you unplug your TV & push all your furniture into the centre of the room ready for a clean drop cloth to go over them it allows the painter to focus on painting.
Door handles, blinds, and fixtures were removed before the painter's arrival - Removing all your door handles, blinds & other fixtures which may slow your painter down it ultimately allows the process to speed up considerably.
Paint walls only - If your ceilings & trims are in good condition repainting your walls will definitely save you dollars.
No carpet - This makes every painter’s day, when there is a job with no carpet painters can work so much faster without worrying about painter spillage.
One coat refresh to walls and ceilings - By only applying a single coat refresh is a great idea to decrease your cost of interior house painting provided you are repainting using the same colour otherwise, you may have coverage issues.
